Indiana Tractor-Trailer Accident Attorneys
If you were injured in a collision with a tractor-trailer, you probably feel betrayed, or at least shocked. We rely on tractor-trailers to transport goods, and Indiana law requires that the drivers of these vehicles operate them safely. When they don’t, property damage, serious bodily injury, and even death may result.
The average tractor-trailer plus cab is 70-80 feet long and can weigh about 80,000 pounds, depending on the weight of the load. The average passenger car weighs approximately 5,000 pounds, according to the truckers’ report. Due to the enormous size of tractor-trailers compared to a passenger car, truck drivers, especially inexperienced or improperly trained drivers, can cause catastrophic accidents.
If you or a loved one sustained injuries in an accident with a tractor-trailer, you may be entitled to compensation for your pain, suffering, and damages. Contact the Indiana truck accident lawyers of Custy Law Firm | Accident & Injury Lawyers at (219) 286-7361 to schedule a free consultation with one of our experienced attorneys.
Do I Need A Tractor-Trailer Accident Lawyer?
If you were injured in a collision involving a tractor-trailer, you need a lawyer to help you obtain all the money to which the law entitles you. As lawyers, our job is to protect your interests and help you get justice and compensation for your injuries. Your job is to heal your body. Because the legal system is complex, you’ll increase your chances of getting a full and fair amount of money for your injuries if you hire an experienced truck accident lawyer.
If you have legal representation, your attorney can communicate, on your behalf, with all the other parties’ attorneys as well as with insurance company representatives. It is vitally important to have someone to represent your interests. Do not speak to anyone about the accident before you have a chance to talk to an attorney. Our skilled attorneys can help to make sure that your right to recover fair and equitable compensation for your injuries and damages is not compromised.
After you retain us, we will use our resources to conduct a thorough and detailed investigation into the facts surrounding the accident. This investigation will reveal what actually happened. It will also help to identify all the parties responsible for the accident. It will help the attorney quantify the amount of compensation you are entitled to. When making a claim for compensation, the attorney must have documented evidence to support the amount sought. A proper investigation will provide this information.
When you hire a lawyer, they will be able to tell you all the elements that go into determining how much compensation you might be eligible for. These items include your current and future medical bills, lost wages, pain and suffering, and if the injuries require it, possibly accommodations made inside your home. In the event you are unable to return to your job at all because of disability resulting from your injuries, you may also be compensated for your lost future income. Your attorney can advise you about which of these will apply to you and what other factors may be included.
If you attempt to handle your claim by yourself, you may fail to get compensated for expenses that may arise in the future. Once your claim or lawsuit is closed, you may not ask for more money even if the additional expenses are due to the accident.
An attorney can use their skills and resources to determine why the accident happened, who is responsible for the accident, and what amount is fair compensation for your damages and injuries. You owe it to yourself to have legal representation. You need someone well-versed in truck accidents.
If our firm represents you, one of our experienced attorneys can deal with the insurance companies, so you don’t have to. The insurance company representative’s job is to pay as little as possible to victims. Any amount they offer you may not cover your current expenses, let alone your future expenses. Remember, insurance company adjusters do not represent you. A skilled accident lawyer can help you obtain all the compensation for your injuries and damages, whether through negotiations with the insurance company or by taking your case to trial.
Statistics show that you may end up recovering three times as much if you have legal representation than if you attempt to handle the matter on your own.
You are probably wondering how much an attorney will cost. The lawyers of Custy Law Firm | Accident & Injury Lawyers take all our cases on a contingency fee basis. What that means is that you pay us nothing up front. If we don’t get compensation for you, you owe us no fees. It’s that simple. We don’t win unless you do. Call us today at (219) 286-7361 for your free, no-obligation consultation.

What Causes Tractor-Trailer Accidents?
We have handled thousands of accident cases over the years and are skilled in our aggressive representation of those who were injured in truck accidents. We know that there are many reasons tractor-trailer accidents occur, and we know the ins-and-outs of creating winning strategies in these types of cases.
We can represent you in accident cases that result from truck driver errors, such as:
- Distracted driving
- Inadequate or improper training
- Driver’s failure to check blind spots
- Driver’s failure to properly signal
- Driving while intoxicated or under the influence of a controlled or illegal substance
- Driver fatigue
- Driver’s lack of familiarity with the roadway
- Reckless driving
The accident could also have been caused by mechanical issues with the truck or improper loading or securement of the cargo.
Parties other than the driver may be responsible for the accident. We will conduct a thorough investigation of the crash to discover all the parties who were at fault for the accident. Potentially liable parties are the trucking company, other drivers on the roadway, and government bodies responsible for roadway maintenance.
The lawyers of Custy Law Firm | Accident & Injury Lawyers are skilled in negotiating for the best settlement for you in any of these types of cases. If an appropriate settlement cannot be reached, we are prepared to go to trial to stand up for your rights.

- Dental injuries
- Traumatic brain injuries
- Paralysis

Indiana Laws and Your Compensation
Many people think that because the accident was partially their fault, they are not entitled to any compensation. This is not true in Indiana. As long as you are less than 51 percent responsible for the accident, you still may be entitled to compensation for your injuries. Under Indiana law, the amount of compensation that you ultimately get will be reduced in proportion to your amount of responsibility for the accident.
For example, if the court finds that you were 20% responsible for the accident and also finds that you are entitled to $100,000 in damages, then you could collect $80,000. The $100,000 in damages is reduced by 20%, which is the percentage you were found to be at fault.
In the state of Indiana, you generally have two years from the date of the accident to file a lawsuit because of a law called the “statute of limitations.” You need to speak to a personal injury attorney so that you do not forfeit your right to compensation by waiting too long to make a claim.
